Which trees are protected in Armidale Regional Council?
Trees about 6m tall or 30cm trunk (diameter at base) or larger are generally protected and need approval.
Armidale protects trees exceeding 6 metres in height (with exceptions for C2/C3/C4 zones); minor pruning exemptions allow up to 20% canopy reduction and branches โค50mm; RFS 10/50 clearing available outside heritage areas; but trunk diameter threshold and crown spread threshold require direct source confirmation as they were not accessible or substantiated by web sources.
When you may not need approval
- Dead or dying trees (certified by Level 5 arborist)
- Minor pruning (up to 20% canopy, branches โค50mm diameter)
- Rural Fire Service 10/50 vegetation clearing (outside heritage areas)
- Trees that fell/partially fell in storm and pose danger
How to apply
Submit the Application for Tree Removal or Pruning Form available from council; allow approximately 28 days for assessment. Heritage-listed properties require additional Application for Minor Works for Heritage Items.
Other rules that can override the above
- RFS 10/50 Vegetation Clearing scheme โ in a designated bush-fire area you may be able to clear trees within 10m of your home (and underlying vegetation within 50m) without council approval. Check eligibility with the NSW RFS online tool; it does not override threatened-species or federal law.
- Heritage items and heritage conservation areas โ trees are usually protected regardless of size and most exemptions fall away.
- Threatened species, endangered ecological communities and Aboriginal places โ exemptions generally do not apply.
- Federal EPBC Act โ separate Commonwealth approval can be required if removal would significantly impact a nationally listed species or community.
