Which trees are protected in Snowy Monaro Regional Council?

Trees about 4m tall or 32cm trunk (council states ~100cm trunk circumference) or larger are generally protected and need approval.

Rule from DCP Chapter 7.1 applies ONLY to native trees in non-rural zones (zones excluding RU1-RU4). Rural zones governed by Local Land Services Act. Eucalypt species have lower threshold: 60cm diameter vs 1m for other species. Protected trees: height greater than 4m OR diameter equal to or exceeding 1m at 1.3m (single-trunk) OR circumference equal to or exceeding 1m at 1m height (multi-trunk). Also includes hollow-bearing trees, heritage trees, all public land trees, and trees in E2/E3/E4 environmental zones. Applies to private land in non-rural zones.

Other rules that can override the above

  • RFS 10/50 Vegetation Clearing scheme โ€” in a designated bush-fire area you may be able to clear trees within 10m of your home (and underlying vegetation within 50m) without council approval. Check eligibility with the NSW RFS online tool; it does not override threatened-species or federal law.
  • Heritage items and heritage conservation areas โ€” trees are usually protected regardless of size and most exemptions fall away.
  • Threatened species, endangered ecological communities and Aboriginal places โ€” exemptions generally do not apply.
  • Federal EPBC Act โ€” separate Commonwealth approval can be required if removal would significantly impact a nationally listed species or community.
