Which trees are protected in Cairns?

Trees about 7.5m tall or larger are generally protected and need approval.

Significant Tree = tree greater than 7.5m in height (natural ground level to crown top). Private land trees protected via CairnsPlan 2016 Planning Scheme Vegetation Management Code and overlays (Vegetation Conservation Overlay, Hillslopes Overlay, Heritage Overlay, Conservation Planning Area). For properties not in overlay areas, vegetation damage is "accepted subject to requirements" in residential zones, meaning if requirements are met, development approval not required. Tree Audit/Retention Value Report by Certified Arborist may be required for Exceptional Trees.

When you may not need approval

  • Removal of dead wood
  • Removal of hazardous limbs
  • Regrowth removal associated with maintenance of pasture/cultivated fields/firebreaks/lawn-garden areas/boundary fence lines
  • Pruning to avoid damage to above-ground services
  • Routine pruning per AS4373 standard
  • Dangerous tree removal if Certified Arborist determines imminent risk

How to apply

Development Permit for Operational Works (Vegetation Clearing) may be required. In residential zones, vegetation clearing is "accepted subject to requirements" (must comply with CairnsPlan 2016 code requirements). Council may request Tree Audit and Retention Value Report from Certified Arborist.

Other rules that can override the above

  • Council Vegetation Protection Orders / significant tree registers.
  • State Vegetation Management Act (native vegetation).
  • Federal EPBC Act.
